4. Payment Terms and Conditions

Unless otherwise agreed in writing, all prices are quoted in Canadian dollars (CAD) and are subject to applicable federal and provincial taxes, including GST/PST/HST as applicable.

Failure to pay any amount when due may result in suspension of work, cancellation of orders, retention of goods, late fees where permitted by law, collection efforts, and recovery of reasonable costs associated with collection and enforcement.

Any chargeback or payment dispute must first be raised with Maple Crest Furnishings Ltd. in good faith. Unauthorized chargebacks may be contested to the fullest extent permitted by law.

5. Cancellation and Refund Policy

Because our services may involve custom design, bespoke fabrication, procurement, restocking restrictions, and labour scheduling, cancellation and refund rights may be limited.

Any approved return, cancellation, or refund may be subject to inspection, restocking fees, administrative fees, return shipping or pickup charges, and deductions for damage, missing parts, or use, to the extent permitted by applicable law.

Nothing in these Terms is intended to limit any non-waivable consumer rights under applicable Canadian law or provincial consumer protection legislation.

6. Liability Limitations

To the maximum extent permitted by law, Maple Crest Furnishings Ltd. shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profit, loss of business, loss of data, loss of goodwill, or business interruption arising from or related to our services, products, website, or communications.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the services or products provided by Maple Crest Furnishings Ltd. shall not exceed the amount actually paid by you to Maple Crest Furnishings Ltd. for the specific product or service giving rise to the claim.

We do not guarantee that materials, finishes, grains, colours, fabrics, veneers, woods, stones, or other natural products will match samples exactly, as variations are inherent in furniture and finishing materials. We are not responsible for normal wear and tear, misuse, improper maintenance, environmental damage, or damage caused by third-party movers, installers, contractors, or customer handling after delivery.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, wilful misconduct, or gross negligence where such limitation is not enforceable.

7. Intellectual Property Rights

All content, concepts, drawings, plans, renderings, design proposals, product descriptions, photographs, logos, text, graphics, and other materials created or used by Maple Crest Furnishings Ltd. remain the property of Maple Crest Furnishings Ltd. or our licensors unless otherwise agreed in writing.

Subject to full payment, you are granted a limited, non-exclusive, non-transferable right to use any deliverables provided to you solely for the purpose intended under the relevant order or project.

You may not reproduce, distribute, modify, reverse engineer, sell, sublicense, or publicly display our intellectual property without our prior written consent. Design concepts and proposals may not be shared with third parties for competitive use, fabrication, or replication without our authorization.

If you provide us with images, plans, trademarks, logos, specifications, or other materials, you represent and warrant that you have the right to do so and grant Maple Crest Furnishings Ltd. a licence to use those materials as necessary to perform the requested services.

8. Data Protection and Privacy

Maple Crest Furnishings Ltd. collects, uses, and discloses personal information only as necessary to provide services, process transactions, coordinate delivery and installation, communicate with customers, maintain records, comply with legal obligations, and improve our business operations.

We take reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, use, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

We may disclose personal information to trusted service providers, payment processors, delivery partners, contractors, insurers, legal advisors, or government authorities where necessary and permitted by law.

Maple Crest Furnishings Ltd. shall not be liable for any delay, failure, or interruption in performance caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, fire, flood, pandemic, epidemic, labour disputes, supply chain disruptions, transport delays, power outages, government actions, acts of war, civil unrest, or failures by third-party suppliers or carriers.

If a force majeure event occurs, we may suspend performance, extend timelines, reschedule services, substitute materials where reasonable, or cancel affected orders if continued performance becomes impracticable or impossible.

10. Changes to Terms

Maple Crest Furnishings Ltd. may update or modify these Terms from time to time to reflect changes in our services, business practices, or applicable law. The updated Terms will be effective upon posting or upon notice to you, as applicable.

Your continued use of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services.

11. Applicable Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any dispute, claim, or proceeding arising out of or relating to these Terms, the services, or any transaction with Maple Crest Furnishings Ltd. shall be brought exclusively in the courts located in British Columbia, Canada, unless applicable law requires otherwise.

13. Severability Clause

The failure of Maple Crest Furnishings Ltd. to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision unless acknowledged by us in writing.
